Depending on the size of your restructure, you may be legally required to consult. We will advise what period of consultation you need to follow with your employees. In cases where you plan to make 20 or more individuals redundant or dismiss, you need to consider a collective consultation process, which can become technical and subject to certain considerations.

The consultation periods vary per sized category; for example, where you are consulting less than 20 employees, there is no statutory minimum consultation period, however we still advise to act with caution to ensure a fair and meaningful consultation is followed.

Where you are consulting between 20 – 99 employees, you must provide a minimum of 30 days consultation with those affected before the first redundancy or dismissal, and where you propose to consult with more than 100 employees, you must follow a minimum of 45-day consultation period in line with legislation and best practice.

Failure to consult in line with the law can cost your business money, along with reputational damage, therefore we strongly advise you reach out to NESE HR ahead of any business transformation and organisational design work, to ensure you follow legislation. Do not allow yourself to fall into lawsuits such as P&O Ferries, which had to reward their employees £36.5 million in compensation in 2022.
